Los Angeles Auto Accident Attorneys
5 Things to do when involved in an accident:
1. Call the police and file a police report.
It is absolutely crucial to have a record of how the accident happened at the outset. No matter what the other driver tells you at the scene of the incident, it is to be expected that they will change their story after the the fact. Having a police report at the time of the incident, will help establish a clear record of fault.
Occasionally, the police will not take a police report for certain accidents. In that case, you should take photos of the other driver's license, registration, and insurance card. Also, be sure to write down the other driver's phone number and contact information, as their driver's license may be out of date. All of this information should be forwarded to your Los Angeles personal injury attorney as soon as possible.
2. Take many photos of both vehicles.
Photos, photos, photos. The damage to the vehicles play a crucial role in deterring fault for the accident as well as the force of the incident. Having multiple photos of the scene of the incident and the damage to the vehicles will prove to be very helpful in proving your case at trial.
3. Report the incident to your insurance - but beware!
You should report the incident to your insurance in order that they may move forward on estimating the damage to your vehicle and getting your vehicle repaired. However, BEWARE! You SHOULD NOT GIVE A RECORDED STATEMENT TO EITHER INSURANCE COMPANY! A recorded statement is typically a recorded interview over the phone that is given under penalty of perjury. While these are required in certain situations, they are often not required and effectively act as an opportunity for the opposing side to take your deposition twice. This places you at an unfair disadvantage when compared to the other driver, who is only required to give his deposition once during the course of litigation.
4. Go to the hospital.
If you are in severe pain, you should immediately go to the hospital for a medical evaluation. The injuries may be more serious than you know and waiting could result in additional injury and/or complicate your recovery process.
